[Carl Schmitt documents: Schmitt's views on Erich Kaufmann]

The file consists of a written comment, dictated by telephone, from the [Berlin-based] Institut für Staatsforschung (Institute for State Research) [lead by Reinhard Höhn]. The comment contains neither information about the date of the communication nor about the speaker/author of the message. It deals with an article by Schmitt in the Erinnerungsgabe für Max Weber Band 2, 1923 (Commemorative Edition for Max Weber, Volume 2 from 1923) named "Soziologie des Souveränitätsbegriffs und politische Theologie" where the writings of [Erich] Kaufmann are discussed (among them Kaufmann's work about the clausula rebus sic stantibus) and Schmitt argues that, although they are basically critical, among juridical publications they are the only intensive statement of a new intellectual poignancy.
