Scope and Content

This file contains newspaper clips from several countries written in German, English and French. The clippings were published during 1938 and deal with different topics concerning the Berne trial. Newspaper articles, some anti-Semitic, which clearly attest the authenticity of the Protocols, as well as newspaper articles, which follow the judgment of the Bern trial, to classify them as trash literature (Schundliteratur) and clearly as forgery, are attached. In some articles, the history of origin and dissemination of the Protocols of the wise man of Zion is presented in more detail, while others are discussing the verdict of the appeals procedure. Furthermore, the reasons for the judgment are presented and discussed in more detail. In the appeal court the question of authenticity of the Protocols did not play a role, in contrast to the first Bern trial of 1935. In the appeal court, the only question was whether or not the Protocols were covered by the law of trash literature (Schundliteratur). In the first trial of 1935 testimonies were heard and evidence presented to prove the falsification of the Protocols. The (second) verdict of the Higher Regional Court (Berner Obergericht), was the acquittal of the defendants without compensation. The accusation did not come within the scope of article 14 of the Bernese code on the prohibition of immoral literature (Schundliteratur), under which the appellants had been convicted
