Scope and Content

The opening statement from 1949 describes the moral conflict of functionaries of the state if they decided to oppose Nazi rules like the justification of murder. The one's who actively supported the regime can be easily condemned and the one's who actively opposed lauded, but how to judge the one's who remained in their positions and therefore supported or maybe passively resisted the Nazi rule? The second speech argues the pros and cons of Franz v. Papen's guilt in his support and opposition to Hitler. The third part is a memorandum by the author, a judge recalling a statement written for the head of the court in Bavaria to oppose the retroactive law that legitimized the murders of July 1934. It was meant as the foundation for a broader opposition movement but dismissed for being to dangerous.
